UK Nicotine Pouch Rules Change on 29 October 2026: What Adults and Retailers Need to Know
From 29 October 2026 it becomes an offence across the UK to sell nicotine pouches to anyone under 18, to give them away to promote them, or to sell them at a substantial promotional discount.
The Tobacco and Vapes Act 2026 received Royal Assent on 29 April 2026. Several of its rules for nicotine products, including nicotine pouches, take effect on 29 October 2026. This explainer sets out what changes, based on the Act itself and the Department of Health and Social Care guidance published on 11 August 2026.
The age of sale becomes 18 everywhere in the UK
From 29 October 2026, the age of sale for all vaping and nicotine products is 18 and over. Selling one of these products to someone under 18 becomes an offence. Section 10 of the Act sets this out, and the government guidance confirms it applies in England, Wales, Scotland and Northern Ireland.
It also becomes an offence for an adult to buy, or try to buy, a nicotine product on behalf of someone under 18 (section 11).
Free samples and big promotional discounts are banned
From the same date, the government guidance says it will be an offence to:
- give away a vaping or nicotine product for free where the purpose or effect is to promote it
- sell one at a substantial discount where the purpose or effect is to promote it
- give, or sell at a substantial discount, a coupon for one of these products
Vending machines
The Act also makes it an offence to have management or control of premises with a nicotine-product vending machine (section 12). The Local Government Association lists the vending machine ban among the rules starting on 29 October 2026.
What comes next
The Local Government Association's timeline, accurate as of 21 September 2026, lists further dates:
- 1 January 2027: the "smokefree generation" age of sale for tobacco begins (it covers tobacco, not nicotine pouches)
- 1 June 2027: the planned date for the ban on advertising and sponsorship of vapes and nicotine products
- 2027 to 2029, after consultation: rules on packaging, display, contents, retail licensing and product registration
